Terms of Service

1. Purpose

These Terms of Service ("Terms") govern your use of the Nasly mobile application ("App") provided by Amajors Inc. ("Company", "we", "our", "us"). By installing or using the App, you agree to be bound by these Terms.

2. Definitions

1. "App" refers to the Nasly mobile application provided by the Company.
2. "User" means any person who agrees to these Terms and uses the App.
3. "Pro Subscription" means a recurring paid service offered on a monthly or yearly basis.
4. "Lifetime License (v1)" means a one-time purchase paid service that can be used perpetually within the scope defined in these Terms.
5. "Free Features" means features available without payment, such as local file playback.
6. "Paid Features" means network playback (SMB, FTP, SFTP, WebDAV, DLNA, etc.) and other premium features added later.

3. Acceptance and Changes

1. By installing and using the App, you agree to these Terms.
2. We may revise these Terms within the bounds of applicable law. We will notify users of changes through in-app announcements or this page in advance.
3. If you do not agree to the revised Terms, you may stop using and uninstall the App.

4. Services Provided

1. Playback of local media files (video, audio, subtitles) on your device
2. Playback of media stored on remote servers (SMB, FTP, FTPS, FTPES, SFTP, WebDAV, WebDAVS, DLNA)
3. Casting via Google Cast and DLNA
4. External subtitle loading with automatic encoding detection
5. Background playback and Picture-in-Picture (PiP)
6. Additional features developed and released by the Company

5. Accounts

No signup is required to use the App. Paid products are purchased anonymously through Google Play Store, and purchases are linked to your Google account and an anonymized identifier.

6. Paid Services

6.1 Products

• Monthly Subscription: Pro subscription that auto-renews monthly
• Yearly Subscription: Pro subscription that auto-renews yearly
• Lifetime License (v1): One-time purchase granting perpetual use within the scope of Section 7

6.2 Payment

All payments are processed through Google Play Billing. We do not store your payment details (such as credit card numbers).

6.3 Free Trial

• Install Trial: You may use all Paid Features free for 14 days after first installing the App.
• First Month Free for Monthly Subscription: First-time monthly subscribers receive 30 days of free use. This offer is not available to Google accounts that have previously received the free month benefit.

6.4 Auto-Renewal and Cancellation

• Subscriptions auto-renew at the end of each billing cycle.
• You can cancel at any time via the Google Play subscription management page.
• Upon cancellation, Pro access remains until the end of the current billing cycle. After that, only Free Features are available.

7. Lifetime License Update Policy

The Lifetime License (v1) is provided under the following conditions:

1. Perpetual use guaranteed: All features released up to the purchase date are available for perpetual use without time limit.
2. 3 years of new feature updates: For 3 years from the purchase date, you will receive new features released during that period (new protocol support, new media type support, etc.) at no additional cost.
3. After 3 years: Newly released major features (such as new media type readers or external service integrations) may require a separate upgrade purchase. However, all features you have already received will remain available perpetually.
4. OS compatibility · security · bug fixes · performance improvements: Provided to all users without time limit.
5. Major upgrade discount: If a major upgrade (such as v2) is released after 3 years, existing v1 Lifetime License holders will automatically receive a 50% discount upgrade coupon.

8. Refund Policy

1. Subscriptions: Refund eligibility is determined by Google Play's refund policy. Since we process payments through Google, please submit refund requests via Google Play Customer Support.
2. Lifetime License: Full refund available if requested within 7 days of purchase and if Paid Features have not been substantially used. Submit refund requests to contact@nearten.com.
3. Restrictions on withdrawal: Pursuant to Article 17(2) of the Korean Act on Consumer Protection in Electronic Commerce, withdrawal may be restricted once use of the digital content has commenced.
4. Free licenses granted through coupons are not refundable.

9. Coupons

• We may issue free-use coupons for marketing, events, reviewer distribution, and similar purposes.
• Coupon codes are single-use only. Duplicate use of the same code is prohibited.
• Coupons are valid only within their validity period and are not refundable for cash.
• Selling coupons for value is prohibited. Violations may result in cancellation of coupon benefits.

10. User Obligations

Users must not:

1. Reverse engineer, decompile, or disassemble the App (except as permitted by applicable law)
2. Circumvent the App's payment or entitlement systems
3. Use the App to infringe third-party copyrights or intellectual property
4. Interfere with the normal operation of the App
5. Violate applicable laws or these Terms

11. Intellectual Property

1. The copyright of the App and related content belongs to the Company or its rightful owners.
2. The App includes components distributed under open-source licenses such as LGPL. Details are available in the "Legal Notice" menu within the App.
3. Users must respect the copyrights of content (videos, music, etc.) played through the App. Users are solely responsible for playing infringing content.

12. Service Changes and Termination

1. The Company may change or discontinue all or part of the Service for operational or technical reasons.
2. We will notify users of service interruption in advance through in-app announcements or this page. Unavoidable interruptions may be notified afterwards.
3. If the Company permanently discontinues the Service, we will provide pro-rated refunds for remaining subscription periods. Lifetime License holders will receive compensation per separate notice.

13. Limitation of Liability

1. The Company is not liable for service interruptions caused by force majeure events such as natural disasters, system failures, or network outages.
2. The Company is not responsible for the content, accuracy, or legality of media played through the App.
3. The Company is not liable for functional limitations arising from the user's device environment (OS version, network conditions, etc.).

14. Governing Law and Jurisdiction

1. These Terms are governed by the laws of the Republic of Korea.
2. Disputes arising from use of the Service will be resolved in the court having jurisdiction over the Company's principal office. For users outside Korea (including the EU and US), mandatory consumer protection laws of the user's country apply to the extent required by law.
